Privacy Policy

AERIS respects your privacy and security and wants you to have control over your data. This Privacy Policy applies to Information obtained by AERIS as you use our channels, including corporate websites and portals, applications, platforms (“Services”).

The Privacy Policy describes the types of Information we obtain about you, how we collect, use, disclose, transfer, and store the Information, and with whom we share it. We also describe the measures we take to protect the security of the Information and how you can contact us to access, manage, and delete your data and, if necessary, clarify our privacy practices.

This Privacy Policy has been designed to be useful, transparent, and as simple as possible. It is important that you read it and, if you have any questions, contact us by sending an email to privacidade@aerisenergy.com.br.

Definitions

In addition to the terms indicated in parentheses, we will define the meaning of some terms used in this Privacy Policy, and whenever we refer to them, you will know that they are in this context.

Personal data – is information related to an identified or identifiable natural person. It is data relating to an individual that, alone or in combination with other information, is or can be used to identify them, collected and/or processed physically or electronically. This definition is in line with the LGPD.

Information – is all Information, whether personal data or not, that You will provide to us, that we will obtain from third parties during your use of the Service, or that is created from the use of the Service.

Data Subject – is the natural person to whom the personal data being processed refers.

You – when we say “You” in this Privacy Policy, we are referring to any person who has registered for the Service or simply accessed the Service.

Information We Collect

We collect personal data about you through our Services, and the types of information we may collect include:
Registration data and contact information you provide (name, address, email address, landline and/or mobile phone number);
Username and password when you register for our Services;
Data from your resume and professional history when you apply for a job;
Other Information you may provide to us through the features available on our Services.

Information obtained by automated means through our services

We may also obtain certain Information through our Services by automated means, such as cookies and similar technologies, including technologies designed to obtain Information about the use of our Services. The Information we collect in this manner may include IP address, device identifiers and characteristics, browser characteristics, operating system, language preferences, referring URLs, Information about actions taken on our Services, and dates and times that you access or use our Services. In connection with our mobile applications, we may also collect your phone number and details about your mobile carrier.

A “cookie” is a file that websites send to a visitor’s computer or other internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. If you wish, you can block cookies directly in your browser, preventing them from being created. You can also delete cookies already recorded through the settings of the browser you use. But be aware: if you disable, reject, or block cookies, certain parts of our website may not function properly.

In addition, if you register with us or connect your account with us to a third-party social media network (such as Facebook, Twitter, LinkedIn), we may obtain certain Information about you from the relevant social media network, such as your user ID and/or username associated with that social media network, the Information contained in your public profile on the social media network, and your friends lists. The specific Information we obtain depends on your
privacy settings on the applicable social media network.

How We Use the Information We Collect

We may use the Information collected from and about You to:
Assist in providing our Services;
Create and manage registrations made on our website;
Send promotional materials and other communications, including communications through the Services and outside the Services, such as emails and third-party websites and applications;
Communicate about the progress of selection processes, special events, and market research;

Operate, evaluate, and improve our business (including developing, enhancing, analyzing, and improving our Services; managing our communications; performing data analysis; performing accounting, auditing, and other internal functions);
Protect, identify, and prevent fraud and other illegal activities, claims, and other liabilities;

If you apply for a position at AERIS or we receive your Information in connection with a potential role at AERIS, we may use such Information to evaluate your application and contact you. If you are an applicant, at the time of registration, you will receive more information about how AERIS handles applicants’ personal information, and you will be directed to a platform managed by a third-party partner of AERIS. We may also use your Information in other ways for which we provide specific notice at the time of collection.

If you represent a partner supplier or customer of AERIS, we may receive your personal data in connection with the conduct of our activities (purchasing supplies, selling products, and providing services) and may use such Information to contact you. If you are a supplier, at the time of registration, you will receive more Information about how AERIS handles personal Information, and you will be directed to a platform managed by a third-party partner of AERIS. Information We Share

We may share your Information with:
Service providers in Brazil and other jurisdictions who provide services on our behalf.
Our third-party customers or business partners, such as social media networks and advertising agencies, and other third parties for the marketing purposes of those third parties, such as to serve targeted advertisements.

In addition, when the Information collected from or about You does not identify You as a specific person, we may share it with third parties. We may further disclose Information about You (i) if we are required to do so by law or legal process; (ii) to law enforcement authorities or other government officials and agencies; and (iii) when we believe disclosure is necessary or appropriate to prevent physical harm, financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity. We also reserve the right to transfer Information we have about You in the event of a proposed or completed sale or transfer of all or part of our business or assets (including in the event of a reorganization, dissolution, or liquidation).

We may disclose certain Information to third parties to provide or improve the Services, including with respect to deliveries. In doing so, we require such third parties to handle such Information in accordance with applicable laws.
AERIS does not sell Personal Information to third parties for their sole marketing purposes.

Free Access

To update your preferences, please request at privacidade@aerisenergy.com.br that we remove your Information from our marketing mailing lists and text messages, or contact us.
You have the right to access, review, update, correct inaccuracies, and delete your Personal Information under our control, subject to certain exceptions prescribed by law. When you submit a request, we may ask for certain Personal Information for the purpose of verifying the identity of the person seeking access to their Information records.

How we protect your information

We maintain administrative, technical, and physical safeguards designed to protect the Personal Information we have about You from accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use.
We use principles such as “Privacy by design” and “Security by design” to respect your privacy and protect your data in our internal processes as a whole.
We only process your Information with a high degree of security, implementing industry best practices for data protection, such as encryption techniques, monitoring, and periodic security testing. However, it is not possible to completely guarantee that there will be no interceptions or breaches of AERIS’s systems and databases, as the internet’s security structure is constantly being improved.

Information Transfers

The Services may be hosted and/or managed from a country outside Brazil where You initially provided the Information. We may transfer the personal Information we collect about You to other countries, which may not be considered to have the same data protection laws as the country in which You initially provided the Information. When Your personal Information is in these countries, it may be accessed by courts, law enforcement authorities, and national security authorities in accordance with applicable law. Therefore, you understand and consent to the processing of any personal information about you outside Brazil. Your consent includes the use of cookies and other tracking technologies, as described above. When we transfer your Information, we will protect that Information as described in this Privacy Policy.

For your convenience and information, our Services may provide links to third-party websites, applications, and services that may be operated by companies not affiliated with AERIS. These companies may have their own privacy notices or policies, which we suggest you review. We are not responsible for the privacy practices of third-party websites, applications, or services that are not owned by AERIS.

Updates to our Privacy Policy

This Privacy Policy may be updated periodically and without prior notice to reflect changes in our Personal Information practices.
